1. Acceptance and Agreement
By downloading, accessing, or using the Ohana Mobility application, website, or services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Agreement"). If you do not agree to all terms and conditions contained herein, you may not use the Services.
The Services are provided by Ohana Mobility Ventures, Inc. ("Company," "we," "us," or "our"), a Delaware corporation with its principal place of business at 9663 Santa Monica Blvd, Beverly Hills, CA 90210, and registered to do business in the State of Hawaii as a foreign corporation. These Terms apply to all users of the Services, regardless of access method or device. Your use of the Services constitutes acceptance of this Agreement, which may be updated at our sole discretion at any time. We will notify users of material changes via the application or email. Continued use after notification constitutes acceptance of modifications.
2. Definitions
"Account" means your personal profile within the Services, established through registration.
"Guest" means any individual who accesses the Services through an Ohana Mobility Account.
"Vehicle" means any premium electric or fuel-powered automobile provided by Ohana Mobility for shared use, including but not limited to Moke vehicles and their variations.
"Reservation" means a confirmed booking of a Vehicle for a specified date, time, and duration through the Services.
"Trip" means the period during which you are actively using a reserved Vehicle, from vehicle pickup to return.
"Damage Fee" means charges assessed for damage to a Vehicle occurring during your Trip, unless covered by optional damage protection.
"Services" means the Ohana Mobility application, website, booking platform, vehicle access system, customer support, and all related features and functionality.
3. Eligibility and Account Registration
3.1 User Requirements
To use the Services, you must:
- Be at least 21 years of age
- Hold a valid driver's license recognized by the State of Hawaii or equivalent valid international driving permit
- Upload valid insurance policy covering at least the minimum financial responsibility in applicable states, or purchase Ohana's policy offering during registration process
- Have no major offense moving violations in the past 5 years including:
- Driving while driver's license is restricted, suspended, revoked, or denied
- Vehicular manslaughter, negligent homicide, felonious driving, felony with a vehicle or state law equivalents
- Operating a vehicle while impaired, under the influence of alcohol or illegal drugs, or refusing a sobriety test
- Failure to stop or identify after a crash (including leaving the scene of a crash; hit and run; giving false information to an officer)
- Eluding or attempting to elude a law enforcement officer
- Traffic violations resulting in death or serious injury
- Have no more than 3 minor violations in the last 5 years
- Consent to and authorize us and our affiliates, to the extent permitted by applicable law, to perform or have performed a background check of you and your driving history and/or driving record as described in "Background and Other Consumer Reports" in Section 3.4
- Agree to provide information, including your Driver's License and selfie(s), to us or our identity verification vendor, if any, and allow us or our vendor to validate your driving record
- Be the person to whom the driver's license was issued
- Have not been banned from using Ohana Mobility Services
- Provide accurate, complete information during registration
- Maintain current contact information on your Account
3.2 Account Creation
Registration requires providing a valid email address, phone number, payment method, and driver's license information. You are responsible for maintaining the confidentiality of your login credentials and account information. You agree not to share your Account credentials with any other person. Account access is personal, non-transferable, and non-assignable.
3.3 Hotel Guest Verification
Access to Vehicles at specific properties may require verification of current hotel accommodations at participating properties. We reserve the right to request proof of reservation or occupancy. Guests found to have misrepresented their hotel status may have their Accounts immediately terminated and may be subject to additional charges.
3.4 Background and Other Consumer Reports
You hereby acknowledge and agree that we have the right, but not the obligation, to use a third-party consumer reporting agency to run periodic background, department of motor vehicles driving record and other consumer reports on you in connection with your use of Ohana's Services. You understand and agree that we may use the information from these reports to approve your membership, assess your qualifications to use Ohana's services, and that we retain the right to deny your membership or terminate your Account based on the information in these reports. You hereby represent, understand, and expressly agree that we do not have control over or assume any responsibility for the quality, accuracy, or reliability of the information included in these reports. By agreeing to these terms and using Ohana's Services, you agree to allow us to obtain, review, and consider these reports.
3.5 Account Suspension and Termination
We reserve the right to suspend or terminate your Account, without refund and without advance notice, if:
- Your account is used in violation of this Agreement
- You provide false or misleading information
- You engage in prohibited conduct
- You fail to pay fees or charges
- You breach the vehicle use policies
- You violate applicable laws or regulations
- We determine, in our sole discretion, that your use poses a risk to our business or other users
4. License and Use Restrictions
4.1 Limited License
We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Services solely for lawful purposes and in compliance with this Agreement. This license does not include the right to:
- Modify, edit, copy, translate, or create derivative works of the Services
- Reverse engineer, decompile, disassemble, or attempt to derive source code
- Remove or alter any copyright, trademark, or proprietary notices
- Rent, lease, sell, or transfer rights to the Services
- Use the Services for any commercial purpose outside the scope of vehicle rental
- Develop competitive services or applications
4.2 Prohibited Conduct
You agree not to:
- Allow any unauthorized person to drive or access a Vehicle under your reservation
- Use Vehicles for commercial ride-sharing, delivery services, or transportation for hire (except as specifically authorized by separate agreement)
- Operate a Vehicle while impaired by drugs, alcohol, or medication affecting judgment or motor skills
- Drive recklessly, illegally, or in violation of traffic laws
- Smoke, consume alcohol, or use drugs inside any Vehicle
- Transport hazardous materials, weapons, explosives, or prohibited substances
- Transport animals (except certified service animals)
- Intentionally damage, vandalize, or tamper with Vehicle systems, locks, or safety features
- Disable, bypass, or interfere with vehicle tracking, telematics, or recording systems
- Park Vehicles in unauthorized locations
- Exceed Vehicles' weight limits or capacity
- Permit passengers beyond the Vehicle's legal seating capacity
- Violate any applicable law, regulation, or court order
- Interfere with other users' enjoyment of the Services
- Upload malware, viruses, or harmful code to the Services
- Attempt unauthorized access to Services or systems
- Harvest or collect user data without authorization
- Spam, harass, or threaten other users or Company personnel
4.3 Platform Conduct Standards
When using our Services, you agree to maintain professional and respectful conduct. Communications within the platform or with Company staff must remain lawful and courteous. We reserve the right to terminate service access for users engaging in harassment, discrimination, threats, or abusive language.
5. Vehicle Reservations and Usage
5.1 Reservation Process
Reservations are confirmed through the Services upon real-time availability. Confirmation occurs when you complete payment authorization and receive confirmation via email or in-app notification. Reservation availability is not guaranteed and depends on vehicle availability, location, and your Account status.
5.2 Rental Duration and Extensions
Minimum rental periods are one hour, with hourly increments thereafter. Long-term rentals exceeding 72 consecutive hours require direct communication with Customer Support for authorization and pricing adjustment. Vehicles must be returned by the reserved end time. Late returns are charged at the applicable hourly rate plus late fees at Company's discretion.
5.3 Vehicle Pickup and Condition
Upon pickup, you are responsible for:
- Confirming the Vehicle's exterior condition matches the in-app inspection guide
- Verifying fuel or charge level and any pre-existing damage
- Reporting discrepancies within 15 minutes of pickup or forfeiting the right to dispute pre-existing damage charges
- Ensuring all Vehicle systems function properly before departing
- Noting any mechanical or safety concerns immediately
5.4 Driver Conduct During Trips
During active Trips, you agree to:
- Drive safely and follow all traffic laws and regulations
- Maintain control of the Vehicle at all times
- Not allow unauthorized individuals to operate the Vehicle
- Not exceed posted speed limits or drive recklessly
- Exercise reasonable care to prevent damage or accidents
- Respond promptly to safety alerts or system notifications
- Report accidents or incidents immediately through the app or by phone
- Maintain appropriate vehicle appearance and cleanliness during use
5.5 Parking and Location Restrictions
Vehicles must be parked only in designated Ohana Mobility zones, customer parking areas of participating hotels, or as specifically authorized through the app. Unauthorized parking locations include fire lanes, handicap zones (unless properly designated), private property, or areas expressly prohibited by signage. Vehicles parked in violation of these restrictions may be towed at your expense, and you will be charged all associated recovery and towing fees.
5.6 Weather and Environmental Conditions
Ohana Mobility reserves the right to restrict or suspend Services during severe weather, natural disasters, or hazardous conditions including high winds, heavy rain, flooding, or tsunami warnings. No refunds are provided for suspensions due to weather or environmental factors beyond Company control.
5.7 Trip Monitoring
Vehicles are equipped with GPS tracking, telematics monitoring, and cabin recording systems. By using the Services, you consent to monitoring of vehicle location, speed, acceleration, braking patterns, and in-cabin audio/video recording during your Trip. This data is collected for safety, liability, and service quality purposes. Recordings may be disclosed to law enforcement or in legal proceedings.
6. Fees, Charges, and Payments
6.1 Pricing Structure
Fees are displayed in the Services before reservation confirmation and vary by:
- Vehicle type and model
- Rental duration
- Time of day and seasonal demand
- Geographic location within Hawaii
- Optional protection packages selected
Hourly rates, daily rates, and weekly rates are available. Rates are subject to change at Company's discretion with notice provided via the app or email. Changes to rates for future reservations do not affect confirmed existing reservations.
6.2 Authorized Charges
By providing a payment method, you authorize Ohana Mobility to charge:
- Hourly or daily rental fees for active Trips
- Fuel surcharges or charging fees if applicable
- Late return fees
- Damage charges and Damage Fees
- Cleaning fees for excessive soiling or contamination
- Towing and recovery fees
- Traffic citations, parking violations, and toll fees incurred during your Trip
- Administrative fees for violation of Use Policies
- Any other fees specified in this Agreement or displayed in the Services
6.3 Payment Processing
All payments are processed through our secure payment processor. We do not collect or store complete credit card data. Payment card information is handled by third-party payment processors in compliance with PCI-DSS standards. Failed payment authorizations may result in Account suspension and reservation cancellation.
6.4 Billing and Invoices
Charges are applied to your authorized payment method automatically. You will receive itemized invoices via email showing all fees and charges. You are responsible for reviewing invoices and reporting discrepancies within 30 days of charge date.
6.5 Refund Policy
No refunds are provided for voluntary cancellations or unused portions of reservations after Trip commencement. Cancellations made more than 24 hours before reservation start time receive a full refund of rental fees minus any applicable processing fees. Cancellations within 24 hours of reservation start are non-refundable. Refunds for Company-caused service failures are provided as trip credits only, not cash refunds.
7. Damage, Liability, and Financial Responsibility
7.1 User Responsibility for Damage
You are financially responsible for all damage to the Vehicle occurring during your Trip, regardless of fault or cause, including:
- Collision damage
- Dents, scratches, paint chips, or body panel damage
- Mechanical or electrical system damage
- Interior damage including seats, carpets, controls, or trim
- Glass damage including windows, mirrors, or lights
- Tire punctures, blowouts, or sidewall damage
- Frame or structural damage
- Component theft or missing equipment
- Damage caused by weather, falling objects, or vandalism during your active Trip
- Damage from driving on roads unsuitable for the Vehicle
The Company will determine repair costs based on quotes from qualified repair facilities. You will be charged the full repair cost or replacement value if the Vehicle is deemed a total loss.
7.2 Damage Fee Schedule
Standard Damage Fee ranges (subject to change):
- Minor damage (small dents, scratches): up to $500
- Moderate damage (body panels, glass replacement): $500–$2,000
- Major damage (collision, significant mechanical): $2,000–$7,500
- Total loss or major structural damage: Vehicle replacement value
These are general ranges. Actual charges reflect documented repair costs. Damage fees are in addition to any insurance deductibles or citations.
7.3 Optional Damage Protection
Optional Damage Waiver coverage ($15–25 per Trip, pricing varies) reduces your personal liability for damage to a specified deductible ($500–$1,000). Damage Waiver does not cover damage from prohibited conduct, illegal activity, gross negligence, or violations of this Agreement. Coverage excludes:
- Damage from driving under the influence
- Damage from reckless or negligent driving
- Theft of Vehicle or components
- Damage from prohibited uses (commercial, ride-sharing, etc.)
- Damage from exceeding vehicle specifications or limits
7.4 Traffic Violations and Citations
You are responsible for all traffic citations, parking violations, tolls, and fines incurred during your Trip. The Company will forward citations to your registered address. You agree to pay all such fines and penalties directly to the issuing authority. The Company may charge a $25–50 administrative fee for processing and forwarding citations. Failure to pay citations may result in Account suspension.
7.5 Accident Reporting
Any collision, accident, or incident must be reported immediately:
- Through the app incident report feature, or
- By calling Customer Support at +1 (808) 444-4142, or
- To emergency services (911) for injuries or serious damage
Failure to report incidents may result in fraudulent claim charges and Account termination. You agree to cooperate fully with insurance investigations and provide accurate information.
7.6 Insurance Coverage
The Company maintains liability insurance at Hawaii state-mandated minimum financial responsibility limits. Your personal auto insurance may provide additional coverage for third-party liability. We strongly recommend reviewing your personal insurance policy to understand what coverage, if any, extends to vehicle-sharing services.
Important: The Company's insurance is excess coverage only. Your personal insurance, if applicable, is considered primary. The Company assumes no liability for your medical expenses, injuries, or property damage beyond the scope of state-mandated minimums.
7.7 Indemnification
You agree to indemnify, defend, and hold harmless Ohana Mobility, its parent companies, subsidiaries, officers, directors, employees, agents, and partners from any claims, damages, losses, costs, or expenses (including attorney's fees) arising from:
- Your use of the Services or Vehicles
- Any damage you cause to Vehicles
- Injuries or property damage you cause to third parties
- Violations of this Agreement or applicable laws
- Breach of representations or warranties
- Any third-party claims related to your conduct
8. Warranty Disclaimers and Limitations of Liability
8.1 "AS-IS" Disclaimer
VEHICLES AND SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OHANA MOBILITY DISCLAIMS ALL WARRANTIES, CONDITIONS, AND REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
The Company makes no warranty regarding:
- Vehicle mechanical condition or safety (beyond pre-trip inspection)
- Uninterrupted or error-free service operation
- Absence of defects or malfunctions
- Suitability for particular purposes
- Accuracy of location data or navigation systems
- Security or privacy of data transmitted through Services
Some jurisdictions do not allow warranty disclaimers, so this limitation may not apply to you in full.
8.2 Limitation of Liability
EXCEPT AS REQUIRED BY LAW, OHANA MOBILITY SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunity
- Loss of use or goodwill
- Damages from service interruptions, errors, or omissions
- Injuries or property damage during Vehicle use
- Third-party claims arising from your conduct
- Damage from accidents, collisions, or incidents
- Costs of vehicle repairs or medical treatment
- Any damages exceeding the fees you paid in the 12 months preceding the claim
This limitation applies regardless of whether the Company was advised of the possibility of such damages.
8.3 Sole Remedy
Your exclusive remedy for any claim related to the Services shall be the value of fees paid by you to the Company for the specific Service giving rise to the claim. The Company's liability in any circumstance shall not exceed this amount.
9. Intellectual Property Rights
9.1 Company Ownership
All content, design, text, graphics, software, photographs, videos, logos, and materials comprising the Services ("Company Materials") are owned by or licensed to Ohana Mobility and protected by copyright, trademark, and intellectual property laws.
The Ohana Mobility name, logo, and all associated branding are trademarks of Ohana Mobility Ventures, Inc. Unauthorized use of Company trademarks, logos, or branding is prohibited.
9.2 User Restrictions
You may not:
- Reproduce, distribute, or publicly display any Company Materials
- Modify, translate, or create derivative works
- Use Company Materials for commercial purposes
- Use Company Materials to compete with the Company
- Remove or alter copyright, trademark, or proprietary notices
9.3 License Grant to Company
By uploading, submitting, or providing feedback, reviews, photos, or suggestions through the Services, you grant Ohana Mobility a perpetual, worldwide, royalty-free license to use, modify, reproduce, and distribute such content in connection with the Services and marketing materials.
10. Privacy and Data Collection
The Company collects and processes personal information including name, driver's license information, contact details, payment information, location data, and trip history. For complete details on data practices, see our separate Privacy Policy.
By using the Services, you consent to collection, processing, and storage of the above information. Location data collected through GPS and telematics systems may be retained for 12 months and accessed by law enforcement with appropriate legal process.
In-cabin recording systems capture audio and video during Trips for safety, liability, and quality assurance purposes. These recordings are retained for 30 days unless requested for investigation or legal proceedings.
10.2 SMS Communications and Consent
By creating an Account and providing your phone number, you expressly consent to receive transactional SMS and text messages from Ohana Mobility. These messages include, but are not limited to: account verification codes (OTP), booking confirmations and reminders, vehicle access codes, trip updates, and service alerts.
Message frequency varies based on your use of the Services. These messages are transactional in nature and are not marketing communications. Message and data rates may apply depending on your mobile carrier plan.
You may opt out of receiving SMS messages at any time by replying STOP to any message. For assistance, reply HELP or contact Customer Support at support@ohanamobility.com or +1 (808) 444-4142.
Please note that certain SMS messages (such as one-time verification codes) are required for Account access and security. Opting out of all SMS communications may limit your ability to use the Services, including logging in and completing bookings.
Your phone number is used solely for service-related communications and is not shared with third parties for marketing purposes.
11. Third-Party Services and Links
The Services may contain links to third-party websites, applications, or services. The Company is not responsible for third-party content, services, or policies. Your use of third-party services is governed by their respective terms and privacy policies. The Company makes no warranty regarding third-party services and shall not be liable for any damages arising from third-party services.
12. Dispute Resolution and Governing Law
12.1 Governing Law
This Agreement and all disputes arising from or related to the Services shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law principles.
12.2 Arbitration Clause
BY USING THE SERVICES, YOU AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING FROM OR RELATING TO THIS AGREEMENT, THE SERVICES, OR YOUR USE OF VEHICLES SHALL BE RESOLVED BY BINDING ARBITRATION, NOT IN COURT.
You and Ohana Mobility agree to submit any dispute to final and binding arbitration before a single neutral arbitrator administered by JAMS (Judicial Arbitration and Mediation Services) under its Streamlined Arbitration Rules and Procedures, or if JAMS is unavailable, by the American Arbitration Association (AAA).
12.3 Arbitration Exceptions
Notwithstanding the arbitration clause, the following are not subject to arbitration:
- Claims brought by the Company for unpaid fees or Account violations
- Intellectual property infringement claims
- Claims for injunctive or equitable relief
- Claims for which arbitration is prohibited by law
12.4 Informal Resolution
Before initiating arbitration, you agree to attempt resolution of disputes through informal communication with Customer Support at support@ohanamobility.com or +1 (808) 444-4142. If informal resolution fails within 30 days, either party may proceed to arbitration.
12.5 Arbitration Procedures
- The arbitrator shall have authority to award any relief available under applicable law
- The prevailing party in arbitration shall be entitled to recover attorney's fees and costs
- Arbitration proceedings shall be conducted confidentially
- Judgment on the arbitration award may be entered in any court of competent jurisdiction
12.6 Class Action Waiver
YOU AGREE TO ARBITRATE CLAIMS ON AN INDIVIDUAL BASIS ONLY. CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS ARE NOT PERMITTED.
Each party shall bear its own attorney's fees and costs unless the arbitrator awards such fees to the prevailing party.
12.7 Venue for Legal Proceedings
If any dispute is not subject to arbitration, you agree that any legal action shall be brought exclusively in the state or federal courts located in Hawaii County, Hawaii, and you consent to the personal jurisdiction and venue of these courts.
13. Account Termination and Cancellation
13.1 User-Initiated Termination
You may request Account termination by contacting Customer Support. Upon termination, your access to the Services is immediately revoked. Outstanding fees remain payable. No refunds are provided for termination except as required by law.
13.2 Company-Initiated Termination
Ohana Mobility may terminate your Account, suspend your access, or revoke your license immediately and without notice for:
- Violation of this Agreement
- Non-payment of fees
- Providing false information
- Violation of vehicle use policies
- Engagement in prohibited conduct
- Law enforcement request or court order
- Company's determination that your use poses risk
13.3 Effect of Termination
Upon termination:
- All access to Services terminates
- Pending reservations may be canceled without refund
- Outstanding fees remain due
- Survival provisions continue to apply
- Any vehicle in your possession must be immediately returned to an authorized location
14. Modifications to Agreement and Services
14.1 Changes to Terms
Ohana Mobility reserves the right to modify this Agreement at any time. Material changes will be communicated via email or in-app notification at least 30 days prior to effect date. Continued use of Services after notification constitutes acceptance of modified terms. Your right to reject changes is to cease using the Services.
14.2 Changes to Services
We reserve the right to modify, discontinue, or restrict access to Services, features, or Vehicles without notice or liability. Discontinuation does not provide refunds for previously paid fees.
15. General Provisions
15.1 Entire Agreement
This Agreement, including all schedules and referenced documents, constitutes the entire agreement between you and Ohana Mobility regarding the Services and supersedes all prior or contemporaneous communications, agreements, or understandings. No prior agreements, whether written or oral, remain in effect.
15.2 Severability
If any provision of this Agreement is found invalid, unenforceable, or illegal, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, shall be severed. The remaining provisions remain in full force and effect.
15.3 Waiver
Failure by either party to enforce any provision shall not constitute waiver of that provision or any other provision. Waiver of any breach does not waive waiver of any subsequent breach.
15.4 Notices
Any notices required under this Agreement shall be in writing and delivered via:
- Email to the address on file in your Account
- U.S. Mail to your registered address
- In-app notification
- Posting on the Services
Notices are effective upon transmission (email), upon receipt (mail), or upon posting (app/website).
15.5 Assignment
This Agreement is personal to you and non-transferable. You may not assign, delegate, or transfer your rights or obligations under this Agreement. Any attempted assignment is void. Ohana Mobility may assign its rights and obligations to successors, acquirers, or third-party service providers without your consent.
15.6 Independent Contractor
The relationship between you and Ohana Mobility is that of independent parties. Nothing herein creates a partnership, agency, employment, or joint venture relationship.
15.7 Survival
Sections regarding payment obligations, damage liability, indemnification, limitation of liability, intellectual property, dispute resolution, and confidentiality survive termination of this Agreement.

16. Acknowledgment
BY USING OHANA MOBILITY SERVICES, YOU ACKNOWLEDGE THAT:
- You have read and understand this entire Agreement
- You agree to be legally bound by all terms and conditions
- You understand the liability limitations and release provisions
- You consent to vehicle monitoring, recording, and data collection
- You accept financial responsibility for damage and violations
- You understand that dispute resolution is through binding arbitration
- You are 21+ years of age and hold a valid driver's license
- You provide accurate, truthful information in your Account
Appendices
Appendix A: Hawaii-Specific Disclosures and Regulatory Compliance
A.1 Insurance and Financial Responsibility Disclosure
Hawaii Motor Vehicle Liability Insurance Requirements:
Ohana Mobility maintains liability insurance in compliance with Hawaii Revised Statutes Chapter 431:10C. Minimum coverage limits meet or exceed Hawaii state-mandated financial responsibility requirements:
- Bodily Injury per Person: $40,000 minimum
- Bodily Injury per Accident: $80,000 minimum
- Property Damage: $20,000 minimum
Important Notice: This insurance is provided as excess coverage only and covers only minimum liability limits required by Hawaii law. The Company's insurance will not cover:
- Comprehensive or collision coverage
- Uninsured/underinsured motorist protection
- Personal injury protection (PIP)
- Damage to the rented vehicle (covered under Damage Waiver only if purchased)
- Medical expenses for occupants

Hawaii law does not require Ohana Mobility to provide comprehensive vehicle damage or collision coverage. We strongly recommend that all users:
- Review their personal auto insurance policies before using the Services
- Contact their insurance provider to determine if coverage extends to vehicle-sharing services
- Consider purchasing optional Damage Waiver protection through Ohana Mobility
- Understand any personal insurance deductibles that may apply
- Obtain additional liability coverage if their personal policy excludes vehicle-sharing services
Many personal auto insurance policies exclude coverage for commercial vehicle-sharing services. The Company assumes no responsibility for gaps in your insurance coverage.
A.2 Traffic Violations and Hawaii Law Enforcement
Citation Processing:
Hawaii traffic citations, parking violations, and traffic camera citations are issued to the registered vehicle, not to the renter. Ohana Mobility will:
- Receive citations issued during your rental period
- Forward citations to your registered mailing address with a $35 administrative processing fee
- Process citations within 10–15 business days of receipt from county authorities
- Provide copies of citations in your Account portal within 5 business days of receipt
Your Obligations: You are responsible for:
- Responding to all citations within required timeframes
- Paying all fines and penalties directly to the issuing county authority
- Providing proof of payment to Ohana Mobility upon request
- Paying Ohana Mobility's $35 administrative fee regardless of citation outcome
Failure to respond to citations may result in:
- Driver's license suspension
- Increased insurance premiums
- Warrant for arrest (for unpaid fines)
- Additional penalties assessed by the State of Hawaii
A.3 Hawaii Traffic Laws and Safety Requirements
Seat Belt Law (HRS §286-201):
All occupants, front and rear, must wear seat belts at all times while the vehicle is in motion. Children under 8 years of age or under 80 pounds must be in an appropriate car seat or booster seat. Violation carries a minimum $50 fine.
Distracted Driving Law (HRS §291C-137):
Operating a vehicle while using a hand-held wireless communication device (cell phone) is prohibited except for:
- Hands-free communication systems
- GPS navigation (mounted devices only)
- Emergency calls (limited exceptions)
Violation carries a $150 fine for first offense, $250 for subsequent offenses.
Impaired Driving (HRS §291C-102):
Operating a vehicle while under the influence of drugs or alcohol is a serious felony in Hawaii. Penalties include:
- License suspension
- Criminal charges
- Fines up to $1,000
- Jail time (up to 30 days for first offense)
- Civil liability for injuries or property damage
Ohana Mobility Policy: Vehicles must be returned immediately and intact if the user has consumed any alcohol or substances affecting judgment. Users found to be driving under the influence will have their Accounts terminated permanently and may face criminal prosecution.
A.4 Hawaii Environmental and Natural Disaster Regulations
Environmental Restrictions:
Hawaii Department of Land and Natural Resources (DLNR) enforces strict environmental protections:
- Vehicles must not be parked within 50 feet of any beach access point, reef area, or protected marine sanctuary
- No driving on beaches or designated sand dune protection areas
- No fueling or washing of vehicles in environmentally sensitive areas
- Vehicles must not be parked in areas subject to flooding or inundation
Natural Disaster and Weather Protocols:
Ohana Mobility monitors National Weather Service alerts and suspends vehicle availability during:
- High Wind Warnings (sustained winds >40 mph)
- Services suspended when issued
- All active reservations receive $50 trip credit
- Refunds provided for advance reservations within 24 hours of suspension
- Tsunami Warnings (from NOAA/Pacific Tsunami Warning Center)
- Immediate service suspension
- All vehicles must be returned or relocated to designated safe zones
- Users are responsible for safe return of vehicles to designated pickup points
- No charges applied if stranded during tsunami warning activation

- Geographic areas affected by warnings become no-parking zones
- Users are liable for vehicles abandoned or damaged due to flooding in restricted areas
- Ohana Mobility will alert users in affected areas via app notification

- Complete service suspension 48 hours before anticipated arrival
- All Vehicles recalled to secure facilities
- Users with active reservations receive full refund or rescheduling credit
- No liability for Service interruption
User Responsibility During Natural Disasters: During emergency situations, users must:
- Respond immediately to app alerts regarding vehicle status
- Return vehicles to designated safe zones when directed
- Follow all emergency management instructions from county authorities
- Understand that Ohana Mobility is not liable for damage to vehicles or personal property during natural disasters
A.5 Hawaii Property Tax and Rental Surcharge
General Excise Tax (GET):
Hawaii's General Excise Tax of 4.166% (or 4.7125% in Honolulu) is applied to all vehicle rental transactions. This tax is calculated on the subtotal of rental charges and is displayed separately on invoices. This is a mandatory state tax and is not retained by Ohana Mobility.
Resort Community Benefit Fee (where applicable):
In certain resort areas, an additional community benefit fee of 2–3% may be applied to support local infrastructure and services. This fee is disclosed at the time of reservation confirmation.
A.6 Right-of-Way and Hawaiian Cultural Considerations
Respect for Hawaiian Culture:
Ohana Mobility operates within Hawaii and respects the islands' rich cultural heritage. Users are expected to:
- Respect Native Hawaiian sites, burial grounds, and cultural areas
- Follow all signage prohibiting access to restricted cultural areas
- Show respect for all local communities and residents
- Not violate any local customs or cultural protocols
Vehicles parked in disrespectful locations or used for activities that demean Hawaiian culture or desecrate sacred sites may result in Account termination and civil liability.

- Kona District: Vehicle parking restrictions in downtown Kona after 6 PM
- Hilo District: Speed limits reduced to 25 mph in residential areas

- Lahaina District: Parking restrictions during peak tourist hours (10 AM–4 PM)
- Restricted zones: Road to Haleakala National Park (no vehicle rental services)

- You have reviewed Appendix D and understand all parking restrictions
- You are responsible for identifying permitted parking locations before parking
- Prohibited zone parking is your personal liability
- You will not hold Ohana Mobility responsible for towing or impound fees incurred through your parking choices
- Repeated parking violations may result in Account termination
- Parking permit display (if required) is your responsibility
Appendix E: Additional Disclosures
E.1 Vehicle Connectivity and Telematics Data
Connected Vehicle Systems:
All Ohana Mobility vehicles are equipped with GPS, real-time telematics, and cellular connectivity systems that collect continuous data including:
- Vehicle location (logged every 30 seconds)
- Speed and acceleration
- Harsh braking events
- Navigation system usage
- In-cabin cameras (audio and video)
- Climate control adjustments
- Door lock/unlock events
Data Retention:
- GPS tracking: 12 months minimum
- In-cabin recordings: 30 days standard (extended if incident-related)
- Telematics data: 24 months
- Accident/incident data: Until claim resolution or 3 years
Data Access and Disclosure: Data may be accessed by:
- Ohana Mobility staff (operations, safety, customer service)
- Insurance adjusters (for claims investigation)
- Law enforcement (with valid warrant or legal process)
- Legal counsel (in litigation or disputes)
Users consent to all such access by accepting these Terms.
E.2 Mandatory Arbitration Acknowledgment
Users understand and acknowledge:
- Any dispute will be resolved through binding arbitration
- Arbitration is faster but may limit appeal rights
- You waive the right to jury trial
- You waive the right to class action litigation
- You accept individual arbitration only
- Costs are generally equally split unless arbitrator awards fees to prevailing party
